Lost, damaged and delayed baggage

  1. BAGGAGE LIABILITY LIMITATIONS

    Please note that Myway Airlines is not liable for loss, damage to , or delay in delivery of any perishable property, nor damage to or damage caused by fragile articles, liquids, or perishables, nor for the loss of, damage to or delay in delivery of medicines, orthotics (surgical supports), money, jewelry, silverware, Negotiable papers, securities, business/personal documents, spirits, books/manuscripts, optics, keys, publications, blueprints, painting/works of art, sound reproduction equipment, business samples, artistic items, irreplaceable items, photographs, business equipment, natural fur products, antiques, heirlooms, collectibles, precious metals/stones, photographic/audio/video equipment and related items, computer hardware/software, electronic components/equipment and other similar valuables or commercial effects.     Note: It is very important that you retain for your record a copy of all documents sent to us, acceptance of this form is not an acknowledgement of liability. Liability for loss or damaged checked baggage is limited in accordance with the relevant convention governing international air travel unless a higher value has been declared in advance and excess value charges have been paid. The liabilities for appropriate compensation governed by relevant convention are subject to the provisions of the applicable Warsaw Convention and Montreal Convention, and the terms of Myway Airlines' Conditions of Carriage.

  2. LIABILITY RELEASE NOTICE FOR CHECKED BAGGAGE

    We would like to assure you that Myway Airlines makes every possible effort to take care of your checked baggage. However, it is impossible to avoid certain minor damages incurred during transportation and handling under normal circumstances for reasons beyond our control. In order to protect your baggage, we suggest that a cover layer or appropriate baggage should be used. We would like to advise that Myway Airlines is not liable for the following minor damages and baggage irregularities, which are beyond our control:

    1. MINOR DAMAGES TO SUITCASE

      • Minor damages to extended handles or locks
      • Minor dents in the frame or shell
      • Minor damages to baggage zippers or security straps
      • Baggage polluted by hidden items
    2. BAGGAGE IRREGULARITY

      • Over-sized or over-packed heavy weight baggage
      • Content damage due to inadequate packing of baggage
      • Fragile or perishable items included in the baggage
      • Valuables and important personal effects in checked baggage
  3. CHECKED BAGGAGE

    1. DAMAGE

      Myway Airlines is responsible for appropriate repair costs or replacement of the baggage. Compensation will be payed after proof of the repairing cost (receipt).

      • Repairing baggage minimum compensation - 20USD
      • Repairing baggage maximum compensation - 50 USD

      If, the repairing cost is exceeding 50 USD, the bag will be replaced.

      If, the repairing cost is exceeding 50 USD, the bag will be replaced.

      • Check the weight of the bag on scales;
      • Bag is inspected by Myway Airlines or contracted company’s representative;
      • Fill out Baggage Claim Form clearly and forward it to Myway Airlines Customer Relations or any Bag Services Office of Myway Airlines with following documents as soon as possible:
        • Property Irregularity Report (PIR)
        • Passenger Coupon/Receipt of your ticket or Itinerary/Receipt of your electronic ticket
        • Boarding Pass
        • Baggage Identification Tags
        • Excess Baggage Charge Receipt, if applicable
        • Copy of Passport.

      NOTE: If, a limited release tag was issued for the damage at the station of departure, MYWAY AIRLINES declines responsibility. Upon request the damaged baggage must be available for inspection. Be advised, that MYWAY AIRLINES is not liable for damaged items mentioned in Chapters - Baggage Liability Limitations, Liability Release Failure to return the collected documents within 7 days from the date of arrival, this case will be considered as closed.

    2. DELAYED/LOST BAGGAGE

      If your baggage is still missing after seven days, we will send you a "Baggage Claim Form" to fill out. In case of unsuccessful tracing, this form will service as your notice of claim. This form will help us locate your baggage and process any related compensation. Please complete and return the form including below documentation to Myway Airlines as soon as possible. Failure to include the following documentation may affect the processing of your claim:

      • Property Irregularity Report (PIR)
      • Passenger Coupon/Receipt of your ticket or Itinerary/Receipt of your electronic ticket
      • Baggage Identification Tags
      • Excess Baggage Charge Receipt, if applicable
      • Expert's report on value of damaged or lost property, if applicable.
      • Receipts to prove the value of items passenger had in his/her lost luggage (in case of existence).
      • Copy of Passport.

      Unless a higher value has been declared in advance and excess value charges have been paid, liability for loss or damaged checked baggage is limited in accordance with the relevant convention governing international air travel. The liabilities for appropriate compensation governed by relevant convention are subject to the provisions of the applicable Warsaw Convention (USD 20 per kilogram) and Montreal Convention. Once collected all documents, please forward them to Myway Airlines Customer Relations Service office or you can forward it to any Bag Services Office of Myway Airlines. Failure to return the collected documents within 21 days from the date of arrival, we will assume that you have received your property by other means and this case will be considered as closed.

  4. CARRY-ON BAGGAGE

    Myway Airlines is not liable for any loss or damage to carry-on (unchecked) baggage, unless such loss or damage is due to our negligence. Under such circumstances, liability for the baggage is limited in accordance with the relevant convention governing international air travel. The liabilities for appropriate compensation governed by relevant convention are subject to the provisions of the applicable Warsaw Convention (USD 20 per kilogram) or Montreal Convention.
